These terms explain how you may use Orbily’s website and mobile app, including the beta. “Orbily”, “we” and “us” refer to Orbily, the service operator. Contact us at info@joinorbily.app. By using the service, you agree to these terms. If you do not agree, please do not use it.
1. What Orbily provides
Orbily helps families and groups organise everyday plans, share event photos, share locations, record journeys and check in with each other in private groups called orbits. Features may differ by device, permissions, plan and beta version. Features marked “coming soon” are not currently available.
2. Beta access and your account
Joining the beta list is free and does not guarantee an invitation or a release date. We use your email to manage access and communicate about the beta. No paid subscription starts when you join the list. Any future paid plan will show its price and terms before you choose it.
Give accurate account information, keep your sign-in details secure and tell us if you suspect unauthorised access. If you are under 18, a parent or guardian must review these terms with you and supervise your use. Do not create an account if you are below the minimum age for valid consent under the laws that apply to you unless the required parental authorisation has been provided.
3. Sharing and tracking
Only share your own location, or another person’s information with their permission and any required parental authorisation. Do not use Orbily for covert surveillance, coercion, harassment or controlling another person. Membership of an orbit is not permission to track someone against their wishes.
You control the permissions and sharing options available in the app and your device settings. Stopping live sharing does not automatically delete previous journeys, messages, photos or other shared content. Other members may already have seen, saved or copied information you shared. Our privacy policy explains recording and retention in more detail.
4. Safety and driving
Orbily is a coordination tool, not an emergency response service, medical device or guarantee of someone’s safety. Locations, arrival estimates, alerts and driving scores can be delayed, incomplete or inaccurate because of signal, battery, permissions or other limitations. Do not rely on them as your only way to check on someone.
In an emergency, contact the relevant emergency services directly. Never interact with the app while driving. Driving insights are informational estimates, not professional driving advice, insurance assessments or proof that a journey was safe.
5. Your content and other people
You keep ownership of the photos, messages and other content you upload. You give Orbily a limited permission to store, process and display that content only as needed to provide the service and carry out your sharing choices. You must have the right to upload it and respect the privacy of people shown or named in it.
Do not upload unlawful, abusive or infringing content, impersonate someone, bypass access controls, interfere with the service or distribute malicious software. Report concerns to our contact email. We may restrict access or remove content where reasonably necessary to protect people, comply with law or address a serious breach. Where appropriate, we will explain the reason and give you a way to contact us about it.
6. Availability and changes
Beta software may contain bugs and may change or be withdrawn. We aim to operate the service with reasonable care, but cannot promise uninterrupted access or that every feature will work on every device. Keep your own copy of important information. We will explain material changes to these terms and give reasonable notice when possible; changes required urgently for security or law may take effect sooner.
7. Ending your use
You may stop using Orbily at any time and use the available account-deletion controls, or contact us for help. To leave the beta list, email us from the address you registered. Deletion and the treatment of shared content are explained in the privacy policy. We may suspend or end access for a serious or repeated breach, proportionately and with notice where practical.
8. Responsibility and your rights
We are responsible for losses caused by our failure to use reasonable care where the law makes us responsible. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud or death or personal injury caused by negligence, or limits your statutory consumer rights.
We are not responsible for another member’s actions or losses that were not reasonably foreseeable. These terms do not remove any mandatory protections or right to bring a claim that you have under the law where you live. Please contact us first if something goes wrong so we can try to resolve it.
